    BEWARE OF THE BIOMETRIC INFORMATION PRIVACY ACT

    Over the past year and a half, Illinois has seen an explosion in the number of class-action lawsuits against employers alleging violations of the Illinois Biometric Information Privacy Act (“BIPA”). This law prohibits companies from using finger- or hand-scan technology or otherwise collecting or storing biometric information without obtaining consent and making certain disclosures.

    Described as a gift to the plaintiffs’ bar, the costs of failing to abide by BIPA’s strict requirements are $1,000 for each negligent violation and $5,000 for each reckless violation, which can multiply to staggering amounts in a class action involving many employees. Attendees at this presentation will learn how to ensure compliance with BIPA, in order to avoid becoming the next unwitting victim in this wave of lawsuits.

    This month we are joined by Julia S. Wolf, from Jackson Lewis, her practice focuses on representing employers in workplace law matters, including preventive advice and counseling.
